Inter-state Tobacco Sales

There is a trend to apparently drive businesses into bankruptcy that sell tobacco products. From what we have been able to determine, this is primarily fueled by actions of New York Attorney General Eliot Spitzer.
So far, the means of delivery has been severely curtailed, and the primary method of payment (Visa/MasterCard) has been eliminated.
This means that the product, still used by some 130 Million Voters, will only be available at local retail outlets. This destruction of competition, gives an unfair advantage to said retailers, and a potential for price gouging in the worst extreme, while removing the vast selection of tobaccos and accessories for the enthusiast.
This is creating a 'red-line' effect, of eliminating inter-state competition. This strikes us as a potential anti-trust, potential geographic monopoly, and possibly un-constitutional.
While some may argue that this is due to age verification, a minor is UNABLE to own a credit card! Therefore, age is already verified. If anything, using money orders, will increase the potential of selling to minors.
This is outrageous.
Tobacco is still a legal substance. In addition, many of these retail stores sell other non-tobacco related items such as collectibles, art, music, etc...
The furtherance of these regulations, as well as recent changes in policy regarding shipping, outrage the tobacco enthusiast culture that is prevalent in the United States.
