We applied for planning permission in Febuary 2003 to moor the vessel on our own mooring. She is replacing our previous home, the 120ft M.T.B. 'Lunasea' which sank with all our possesions on January 1st 2003. These plans included all measurements and the planning officers recommmended that they be approved. The decision was defferred at three separate monthly meetings.
We are required to clear the debris from the previous vessels (including 'Lunasea' and all it's contents). Also we had to remove the 60ft tug 'Briget' at the first available high tide.
Having awaited three months for a decision we decided to bring the vessel onto the cleared mooring on the last set of spring tides, having complied with all conditions except the removal of the tug which needed a particularly high tide. At the following planning meeting (23rd June 2003) a committee of seven councilors voted to refuse planning permission on the grounds that the vessel was now too big, even though it fits in the mooring and the measurements were known back in Febuary 2003.
We have six months to appeal their decision. However, at the planning meeting on 18th August a committee of five councilors voted to issue an enforcement notice to remove the vessel from the site, BEFORE we have had our appeal heard.
We believe we have been treated extremely unfairly. We have lived on the riverbanl for 23 years. This vessel is our home and we do not intend to remove her.
