BACKGROUND SUMMARY:

Marriage laws are the latest political battleground for extremists.

One side is lining up court cases and shopping for judges to change our laws from the bench.
The other side wants to write a definition of marriage into the US Constitution.

Most Americans oppose both of these tactics.

It is difficult for politicians to ignore the pressures from the activists and demagogues advancing on Washington.
So, even though most Americans hope that the federal government will do nothing, it is unlikely that cool heads will prevail if they remain silent.

It is sad that we must amend the Constitution in order to keep it the same. But the fact is that unless we explicitly reaffirm the principles that are already embodied there, one of these two extremes will change the Constitution to mean something that violates broadly accepted traditions of our nation.

(1) It is important to sign it. This encourages others that Common Sense can and will prevail.

PETITION STATEMENT:

We do not want to see marriage defined in the US Constitution, nor do we want the constitution to be improperly used to invalidate the meaning of marriage.

Defining marriage is not an appropriate role for any branch of the Federal government.
Defining marriage is not an appropriate role for any judge.

We ask that our US Congress send to the states for ratification the "Common Sense Marriage Amendment".

Section I
Nothing in this Constitution shall be construed to require marriage to be recognized as anything other than the union of a man and a woman; nor shall this Constitution be construed to require that the legal incidents of marriage be conferred upon unmarried individuals, couples, or groups.

Section II
This amendment shall not limit the ability of the citizens in any State to alter their definition of marriage. However, no Federal Court, nor any court of any State, shall have the power to define marriage, nor the power to force another branch of government to do so.

Section III
Nothing in this Constitution shall be construed to empower any court to extend changes of marriage law from one State to another, or from any State to the Federal government.
