Harry Leon, Ph.D., P.E. has been trying to put restrictions on the CSX Railroad in their transloading of dangerous chemicals in the Howell rail yard. This rail yard is adjacent to the Citys drinking water reservoir and many homes and businesses. The CSX railroad filed in Federal Court an injunction against Harry Leon to stop him from testifying at the Board of Zoning Adjustment (BZA) meeting on Dec. 10, 2009 at 12 Noon City Hall. They say that Dr. Leon is the *only* person in the City interested in putting restrictions on the CSX operations.
The Atlanta Zoning Code is clear that businesses handing hazardous, toxic or explosive materials must have a Special Use Permit with *NO Exceptions.* CSX says they are not required since they are a railroad. Dr. Leon has appealed their decision.
Please sign if you are interested in protecting the drinking water reservoir by having CSX apply for a Special Use Permit so the city can put some safety measures in place to protect the drinking water reservoir and the community.
