In 1996 Madison, a fictitious name for my special needs daughter wandered away from a group home at one oclock in the morning while under the care of Babcock Center and South Carolina Department of Disability and Special Needs. While missing she was gang raped. Both agencies contended that they owed no duty to supervise and that Madison was responsible for the traumatizing events that occurred.
After years of litigation and appeals Madison has been raped by the judicial system. She has been denied equal rights even after the SC Supreme Court remanded her lawsuit back to the circuit court deciding that summary judgment should not have been granted. Madison and others like her should have their day in court. Recently Judge James Barber removed Madisons court appointed guardian and mother who had fought to the Supreme Court on her behalf as guardian in the lawsuit at the request of the defense attorney who represents the agencies who was responsible for her rape.
The court appointed GAL guardian ad litem recently settled Madisons case for not even the money to cover her legal fees in fourteen years. This is an example of many cases involving the disabled and the improper care provided by local and state agencies alike. The judicial system is re-victimizing the disabled by denying them the right to judicial justice.
Please support this cause. We must remove judges off the bench who deny civil and constitutional rights and discriminate against the disabled. Please support JUSTICE, a non-profit organization devoted to equal rights for all.
