There is an increasing number of children borne by mixed parents, particularly between women from the Philippines and Japanese men. Many of these children, although recognized by their Japanese father ("Ninchi"), are deprived of Japanese nationality simply because their parents, for one reason or another, are not legally married, and recognition of the child by the Japanese father came after birth.

It has become an issue of national concern because the number of affected children is growing. Under the law, Japanese nationality is given only to children of mixed marriages, and to illegitimate children, but only when recognition of the child (by the Japanese father) comes before the birth of the child ("Taiji Ninchi"). This doesn't apply to illegitimate children who were recognized after birth ("Ninchi"). In this case, marriage between parents is their only hope to acquire Japanese nationality.

On the other hand, under Article 2, Section 1 of the Nationality Law of Japan, a child borne by a Japanese mother and a foreign father are automatically given Japanese nationality even if the parents, in this case, are not legally married.

The number of interracial marriages in Japan is growing because of the internal conditions in Japan and as a result of globalization where the movement of people is almost at pace with the movement of capital and commodities. At the same time, views about family relationship have also changed resulting in increased number of bi-cultural families with illegitimate children.

On April 12, 2005, nine Japanese-Filipino children together with their foreign mothers filed an appeal/petition at the Tokyo District Court to change provisions of the law that grant Japanese nationality to children of mixed parents. These children hope that their rights be heard like other Japanese children.

Demands of the Petition to the 38th Section of the Civil Court, Tokyo District Court:

1. Article 3-1 of the Japan Nationality Law requires marriage of parents aside from child recognition ("Ninchi") from Japanese father. This violates Article 14-1 of the Japanese Constitution that guarantees equal rights to its citizens. We appeal for a fair ruling on the issue, and that Japanese nationality is given to the petitioner.

Demands of the Petition to the The Minister of Justice:

1. Appeal to change the provisions of the Japan Nationality Law, and to grant equal rights to children recognized by their Japanese father ("Ninchi").

Sulat ng Pagsamong hinihiling na baguhin ang Japan Nationality Law

Tuluyang dumadami ang mga batang isinilang ng mga dayuhang ina at amang Hapon. Marami sa mga bata na kahit kinilala o mayroon "Ninchi" ng amang Hapon ay hindi nabibigyan ng Japanese nationality dahil hindi kasal ang mga magulang sanhi ng iba't ibang kadahilanan.

Ang pagkakaloob ng Japanese nationality ay isa mga matitingkad na issue na kinakaharap ng mga bata na naka-depende kung ang mga magulang ay kasal o hindi. Halimbawa, ang mga batang isinilang ng dayuhang ina at amang Hapon na hindi kasal, kapag nai-"Taiji Ninchi" (pagrehistro ng amang Hapon bago isilang ang bata) ay makakakuha ng Japanese nationality. Subalit ang mga nabigyan ng "Ninchi" o kinilala ng amang Hapon pagkatapos isilang ay hindi maaaring makakuha ng Japanese nationality.

Sa kabilang banda, ang mga di-lehitimong anak ng mga Haponesa ay nabibigyan ng nasyunalidad bilang Hapon sanhi ng kanilang relasyon bilang mag-ina sang-ayon sa Artikulo 2, Section 1 ng Japan Nationality Law. Subalit ang mga di-lehitimong anak ng mga amang Hapon sa dayuhang ina ay hindi makakakuha ng Japanese nationality kahit ito ay kinikilala ng kanyang amang Hapon pagkatapos isilang ang bata dahil hindi raw ito naaayon sa Artikulo 2, Section 1 ng Japan Nationality Law at maging sa Artikulo 3 ng Japan Nationality Law. Subalit kung kasal ang mga magulang, sa pamamagitan ng "Ninchi" na ibinigay ng amang Hapon pagkatapos isilang ang bata, ay maaaring batayan para mabigyan ang bata ng Japanese nationality (sa pamamagitan ng pagpapatala Batas Sibil Artikulo 789).

Sa ngayon ay hindi na mapigilan ang pagdami ng bilang ng international marriage dahil globalisasyon at nag-iiba na rin ang pagtingin at relasyon bilang pamilya. Kasabay nito ang pagdami ng mga bi-cultural na mag-asawang hindi kasal na nagkakaroon ng anak. Lalo na't hindi maaaring baguhin ng mga bata ang kaisipan ng magulang "kung magpakasal o hindi" ang magkahiwalay na magulang para makuha ang minimithing Japanese Nationality.

Noong ika-12 ng Abril 2005, siyam na Japanese-Filipino na bata kasama ang kanilang mga ina ay naghain ng apila sa Pandistritong Hukuman ng Tokyo para baguhin ang paraan ng pagpapatunay ng nasyunalidad bilang Hapon. Mithiin ng mga batang ito na maituring ang kanilang mga karapatan katulad ng mga batang Japanese.

Bagay ng Pagsamo

Para sa ika-38 Seksyon ng Kaong Sibil, Pandistritong Hukuman sa Tokyo:

1. Sa Artikulo 3-1 ng Japan Nationality Law, hinihiling ang kasal ng mga magulang bukod sa "Ninchi" ng amang Hapon at ito ay labag sa Artikulo 14-1 ng Konstitusyon ng bansang Hapon na kung saan nakasaad ng pagkakapantay-pantay sa ilalim ng batas at hinihiling na mabigyan ng hatol na bigyan ng Japanese Nationality ang mga nagdedemanda.

Bagay ng Pagsamo

Para sa Minister of Justice:

1. Hinihiling na baguhin ang Japan Nationality Law upang makakuha nang pantay ang lahat ng mga batang kinilala o binigyan ng "Ninchi" ng amang Hapon.
