We the undersigned are deeply concerned that families have the final say as to whether a person becomes an organ donor irrespective of what that persons prior expressed wish was.
Recent legislation has also added the further complication of widening the criteria as to who is family.
We believe in autonomy. The right of that person to decide what happens to their body after their death if an expressed wish was stated prior to that time. We do not believe that any family member, distant relative or others have the right to veto a persons wish to become an organ donor.
We ask that the Parliamentary Health Select Committee in their forthcoming Review of the Human Tissue Act 1964 that they strongly recommend a change in the law that provides that individuals rights are upheld over the wishes of others.
