PELA GARANTIA DAS TERRAS DO POVO PATAXÓ HÃ-HÃ-HÃE

Excelentíssimos Senhores Ministros do Supremo Tribunal Federal,

Preocupados com as violências e as constantes agressões físicas e culturais sofridas pelo povo Pataxó Hã-Hã-Hãe no sul da Bahia, consideramos que é de suma importância a urgente proteção constitucional sobre o território deste povo.

Sabemos que se encontra nesta instância a Ação Cível Originária nº 312-BA, desde o ano de 1982, aguardando neste momento o julgamento dos senhores ministros. No dia 24 de setembro de 2008, o ministro Eros Grau, relator do caso, votou pela procedência da ação, considerando nulos os títulos que incidem na terra dos Pataxó Hã-Hã-Hãe e determinando a retirada dos ocupantes não indígenas da área.

Acreditamos que a continuidade do julgamento desta Ação garantirá o direito constitucional deste povo de viver em sua terra legalmente demarcada já há tantas décadas, pondo assim um fim na lamentável trajetória de violência e brutalidade contra os Pataxó Hã-Hã-Hãe.

Diante do exposto, vimos solicitar de Vossas Excelências o julgamento imediato da ACO n° 312, nos termos do voto do ministro relator, de forma a que o povo Pataxó Hã-Hã-Hãe possa construir e alcançar "sua terra sem males".

Exmo. Mr. Ministers of the Federal Supreme Court,

Highly concerned with the violence and the constant physical and cultural aggressions suffered by the indigenous Pataxó Hã-Hã-Hãe people in the south of the state of Bahia, we consider of utmost importance that the protection of the territory of this people, as promised by the Federal Constitution of Brazil, be realized and secured.

We know that the Original Civil Action n° 312-BA, has been awaiting its judgment by the Judges of this Court since the year of 1982. On September 24, 2008, Judge Eros Grau, referendary of the case, voted in favor of the claim, considering that the titles of property, granted in the past to non-indigenous on land within the demarcated Pataxó Hã Hã Hãe area, are of no value, therefore determining the retreat of the not-indigenous occupants of the area.

We believe that the continuity of the judgment of this Civil Action will guarantee the constitutional right of this people to live on their land, which has been recognized, legalized and demarcated so many decades ago. And also, that this will put an end to the lamentable and ongoing history of violence and brutality against the Pataxó Hã-Hã-Hãe.

With the exposed in mind, we come to kindly request of Your Excellencies the immediate judgment of the Civil Action n° 312, following the vote of the referendary Judge, so that the Pataxó Hã-Hã-Hãe people can create and reach their "Land without Evils.
