Subject: Pardon or commutation for Anthony (Tony) Enis, Inmate # N82931
Executive Clemency Docket # 25231
PETITION TO THE GOVERNOR OF THE STATE OF ILLINOIS
Dear Governor Blagojevich,
I, Anthony (Tony) Enis, Inmate # N82931, born September 12, 1966, in the city of Waukegan, Illinois, having been unjustly convicted of first-degree murder and sentenced to death, and now serving a natural life sentence at Menard Correctional Center, do hereby petition, and am joined in petitioning the Governor of Illinois.
Because Anthony Enis has been continuously incarcerated since August 10, 1987, Tony is serving his nineteenth consecutive year of imprisonment. There is a compelling need for immediate EXECUTIVE CLEMENCY in this case. We the undersigned petition the Governor of Illinois to pardon or commute the sentence of Anthony (Tony) Enis.
By all signatories listed to this petition to the Governor of Illinois to use his powers under the Illinois Constitution, Article V, Section 12, which states the following:
The Governor may grant reprieves, commutations and pardons, after conviction, for all offenses on such terms as he thinks proper. The manner applying therefore may be regulated by law.
Tony is a victim of mistaken identification, or something even more sinister. Eyewitness identification is widely known to be the most unreliable evidence. There is not one shred of physical or scientific evidence connecting Tony to the murder. There is evidence that police reports were doctored or changed or included information that the witnesses admitted they never said. Defense witnesses who could have been helpful were never called to testify, etc.
To this day, Diane Gonzalez Vaughn, Tonys ex-wife and only alibi witness, maintains Tonys innocence and claims that the police emotionally abused and tortured her during sixteen hours of questioning. She was not allowed to testify at either trial.
According to tests and analyses performed in his case by the Northern Illinois Crime Laboratory at the time of the murder, there was no physical evidence connecting him to the murder. Even though the victim was shot at close range (which would have resulted in blood splattering), there was no blood found on his person, clothing, shoes, possessions, or inside the car that he was accused of driving from the murder scene. His fingerprints did not match those found at the crime scene. No evidence that any lead, barium, antimony, copper, or anything discharged from a gun by gas after firing were found on any of his clothing.
Even if you believe Tonys conviction is just, he has been incarcerated since 1987, at which time he was 20 years old. At 40 years of age, that is half of his life already. I believe Tony poses no threat to society and that no further public interest is served by his incarceration. Tonys potential success and value as a private citizen, and his commitment to helping others in the community, far outweigh any reason to keep him incarcerated. Twenty years is enough; Tony deserves a chance to reenter the community.
