Special rules and regulations are now in place for eBay digital delivery that sellers are required to comply with. Sellers have to identify digital items during the listing process and to give specific information about them.

Digital items can be described as products that can be accessed and delivered online. They include digital data and unique information that can be sent to a customer by electronic means. Examples of digital items are: an original song that is sent in the form of an MP3 file, or a recipe for a special dish.

Buyers can search specifically for digital items in selected categories and see the system requirements for the items in which they are interested. They can also avoid looking at information like shipping details, which are not relevant to digital items.

Which items can be delivered digitally on eBay?

Some examples of items that a seller can list for digital delivery on eBay are listed here:
A computer program written by the seller
An e-book written by the seller
A digital picture
A song created and recorded by the seller, in the form of an MP3 file.
A home movie shot by the seller
Authorized resellers can list software, for which they own the online distribution rights.
Sellers must own all rights to the items they want to list for digital delivery on eBay. Sellers are not permitted to make copies of any of the items mentioned above to list them for sale on eBay, unless they have the legal right to do it.

Some of the digital items you may find listed on eBay are e-books and software, which includes antivirus and anti-spyware programs. Games, music, films and out of the ordinary items, like a guide to reading Tarot Cards are also listed, as are drawings and paintings that you can download and print out.

How can I list digitally delivered items on eBay?

All sellers who want to list digitally delivered items for sale on eBay are required to comply with certain requirements:

Sellers of digitally delivered items need to be verified by PayPal and to offer PayPal as the only payment method. Sellers need to use a Verified Premier or Verified Business PayPal account.
Sellers are not permitted to send any malicious, unauthorized, harmful software, or any program that invades the privacy of the customer. This includes viruses, spyware, cookies, spam, etc.
The seller must own the intellectual property rights to the product, or have the authority to sell it.
The sale of any type of pornographic material is prohibited.
Sellers must provide a file location, or alternate delivery method for the digital item.
They need to use a Fixed Price or Store Inventory format. An auction-style format cannot be used. A single buy it now price has to be fixed.
To list a digital item on eBay, you can use a listing tool like Turbo Lister. You can download this desktop software for free and use it to list a large number of items. It is easy to use and will help you to create outstanding descriptions of items. You will see a separate section for digital items, where you can list the item as a digital file or information.


Sellers need to clearly specify that they are offering a digital item and not a regular physical item. They need to ensure that the buyers get the item as soon as they pay.

Sellers are required to provide information about the listing which includes:
The type of file and the system specifications required for using it.
The buy it now price of the item has to be specified.
PayPal, with the immediate payment option is selected automatically as the method of payment. This is the only option available for selling digital items on eBay.
You will be required to specify the method that will be used to deliver the digital item to the buyer. This information will be provided to the buyer only after the payment has been made.
Sellers have to specify the quantity of identical items they want to sell. This can be up to a maximum of 10,000 copies.
You are required to specify if you will give a refund and the specific conditions under which it will be provided.
Sellers need to study the legal agreement carefully and to confirm that they are legally authorized to sell the digital item.
Those who are eBay store sellers, can opt for a Fixed Price or Store Inventory format, otherwise the fixed price format will be selected automatically.

To protect the rights of sellers, information about how the digital items can be obtained is only provided to buyers after they have made the payment. Digital items are not covered by the PayPal seller protection policy.

It is the responsibility of the sellers to ensure that they own the rights to the digital items they list for sale on eBay. They will have to confirm this in a separate legal agreement.

Sellers who list digital items that they are not authorized to sell will face a range of actions, which include:

1. Limitations on their accounts
2. Loss of the status of a PowerSeller
3. Cancellation of their listing
4. Suspension of the account
5. Being referred to the actual owner of the selling rights
6. Legal actions, as specified by the law


To protect the rights of buyers, eBay ensures that they get the digital item as soon as they make the payment, though they are not covered by the eBay Standard Protection Program, or the PayPal Buyer Protection Program. This is a rule that applies to all intangible items.
