A Call for Solidarity with Immigrant Workers of Woodbridge, Virginia.

The coalition of forces between the Police Department and the I.C.E. (Immigration and Customs Enforcement) exposes the real depth of the recently approved Homemade Clear Act.

Just a few weeks after the state of Virginia approved the anti-immigrant legislation proposal HB570, disguised as anticrime, and just a few days after local authorities announced that this law was only going to be applied in cases were the undocumented immigrant had a criminal record or was involved in some kind of illegal activity, the police department of Prince William County in Virginia initiated their own interpretation of this new law, by preying on organized day laborers from the town of Woodbridge.

On October 19, Prince William County, which is located in the northern area of Virginia approximately 35 miles south west of Washington D.C., was the stage for one of the latest massive attacks against the immigrant community in the United States. The detention of 12 workers and the court citations given to 13 other workers, was part of a county police operative designed to specifically target the day laborers that gather at the corner of Route 1 and Longview Drive (behind an area 7-11), waiting for work in this community. The 12 workers (who were unable to provide identification) were referred to the federal authorities for deportation, while the rest of the workers were given court citations for November 29th, under charges of loitering. On October 22nd the workers gave accounts of the facts in their own words: At this place we meet every day with employers who could offer us a job usually at a low paywith this money we maintain our families which are mostly are back in our countries, pay rent, food, etc Several times the employers abuse our situation by not paying us, later they added: The neighboring church of 7 Eleven has allowed us to use their place next to 7 Eleven to wait for the employers. We are organized as the Workers Committee of Woodbridge, a project of the organization called: Mexicans Without Borders. In this way we make an effort to promote and defend our human rights, getting employment to grow personally, learn English, organized a health campaign, a program to recover non paid salaries, cultural activities, etc. with the purpose of dignifying our lives and contributing to the welfare of our families and the development of the community They also declared that some of them were arrested on Church property, and taken by officers to the 7 Eleven Property to be arrested. Then the workers concluded, Even though we had been having direct meetings with the police and other organizations of the county to whom we had been presenting our project, they chose to repress and violate the rights that the Constitution of the United States of America gave usWe are demanding the immediate liberation of our worker brothers and the annulations of charges for the court tickets. We demand that Virginias congress repeals the HB570 and all loitering ordinances. These are unconstitutional concepts that excuse its indiscriminate usage against society, especially towards the immigrant community. because we are sure that to look for employment isnt a crime.

In July 2004, as a discouraging example of the anti-immigrant sentiment in the United States, the Virginia State Senate approved legislative proposal HB 570 that permits police departments the authority to follow immigration laws, through the arrest and detention of illegal aliens This law (parallel to the federal proposal known as the Clear Act) is disguised under the rhetoric of crime busting, and has no reason to be utilized against the workers of Woodbridge. The law provides no basis for the contradicting accounts given by the police, specifically the one of police Captain Tim Rudy, who declared that after the arrests that police had used fingerprinting to identify those workers that supposedly had immigration violations and thats why we (the police) called immigration thats just good police work, he added.
The official rhetoric of 'crime busting,' which was invoked when this law was publicly announced just a few weeks ago by local and state police, including PWC and some progressive pro-immigrant organizations, promised not to apply this law indiscriminately against immigrants; thus allowing our community be fooled.

The arrests contradict the public promise by the local police chief in Virginia, who made a commitment not to apply that law (HB570) indiscriminately against immigrants who were innocent of criminal charges," said Ricardo Juarez, member of Mexicans Without Borders and representative from the Workers Committee Of Woodbridge.
It is a vicious anti-immigrant trap which denies drivers licenses, identification, and permanent residence status to those of us who are undocumented. It reinforces a mortal vigilance at the countrys borders and insists in criminalizing our existence by equating us with delinquency and terrorism. It makes clear that the law closes the door to immigrants and leaves open all the possibilities for justifying repression while leaving us outside of legal protections.
None of those arrested were in possession of drugs or alcohol and none were gang members.

Paradoxically, while Prince William County has witnessed a 182.9\% growth of its population within the last decade, of which 14.5\% is Latino, the county has experienced a reduction in its crime rate for the third year in a row, as shown in the county police department yearly report presented this past May. This is the lowest crime rateweve experience in a significant number of years, said county Chief of Police Charlie T. Deane, who forgot to mention that 21.5\% of the total population growth is owed to the presence of the immigrant community, especially of Latino origin.

In the presence of this situation, we the Immigrant and Day Laborer Support Committee, from Freehold New Jersey; we who have experienced similar attacks from local authorities, want to stretch out a bridge of solidarity to our sisters and brothers of Woodbridge, VA.
We, as immigrants without borders but as integral members of many homes, have felt in our own skin, the abuses endured by our innocent imprisoned day labor brothers.
Aware of the negative repercussions that this isolation will bring to each of their lives and their families, we, immigrants from many countries, from the THREE Americas, who are an essential part of the life of this country:

We call upon all other immigrants in the United States, to all who protect Immigrants Rights, to all citizens of this country, to support the struggle of the immigrant workers of Woodbridge VA, and to call for ALL of their demands to be met.

We demand for our innocent incarcerated brothers to be freed immediately, and for the loitering charges and court citations put against all the other day laborers to be lifted.

We make a call for direct dialogue to be established with those who are affected, without any mediators.

We also make a call for all loitering ordinances to be repealed and declared unconstitutional in the State of Virginia and the entire nation, for it being a tool strategically used for discrimination against minority communities and a green light for laws similar to the HB 570, which obscures the future of all immigrants in all corners of this nation.

The strike organized by the day laborers on Saturday, October 26th, 2004 is an example of courage and determination that shows us that our strength for struggle is in our work force.
In times when the presidential candidates campaign around our communitys necessities in national debates; in times where they seem to recognize that there needs to be a solution for the present obsolete immigration system, which has kept an immense amount of people captive and divided millions of families for the last 18 years; we need to say ENOUGH!

Enough to this state of fear under which our community lives.

Lets unite our voices in a demand for the immediate release of the immigrant workers that were arrested in Woodbridge, VA; together with the drop of their charges.

For all loitering ordinances to be repealed in the state of Virginia and the entire nation!

For HB 570 to be declared unconstitutional!

Say NO to the Clear Act and all anti-immigrant legislation proposals!

NO MORE to the abuse of immigrant workers!

NO MORE to permitting police officers to act as immigration officials!

NO MORE to the use of discriminative laws!

We demand that Immigrant Workers and their Families Human Rights Act, approved by the United Nations, be RESPECTED!

Because to search for work is not a crime, but a dignifying act!

We sign this declaration and invite all those who are interested in joining this petition.

The collected signatures will be publicized in a website, we will send copies of this document to all government and police departments of the state of Virginia, to the civil society and to the media.

Llamado a la solidaridad con los Trabajadores Inmigrantes de Woodbridge, Virginia.


Correlacion de Fuerzas entre Departamento de Policia y I.C.E. (Inmigracion and Customs Enforcement) pone en evidencia la verdadera piel del recien estrenado Homemade Clear Act.


Pocas semanas despues de aprobada en el estado de Virginia una propuesta legislativa anti-inmigrante disfrazada de anticrimen y conocida como la HB 570 que debe ser entendida tal como lo ha denunciado la organizaciуn Mexicanos sin Fronteras y el Comitй de Trabajadores de Woodbridge como una version casera del Clear Act y pocos dias despues de que las autoridades locales anunciaran que su aplicacion seria destinada solamente a aquellos inmigrantes que hubieran cometido crimenes o que se involucraran en actividades ilicitas, el departamento de Policia del Condado de Prince William, VA, inicio su interpretacion de la nueva ley haciendo su primera practica de tiro con trabajadores jornaleros organizados del poblado de Woodbrigde.


El Condado de Prince William situado en el norte de Virginia aproximadamente 35 millas al suroeste de Washington, DC, ha sido escenario del ultimo ataque masivo contra la poblacion inmigrante de los Estados Unidos el pasado 19 de Octubre. El arresto de 12 trabajadores y las citaciones para la corte a otros trece fue parte de un operativo de la policia del condado destinado especificamente contra jornaleros que se congregan diariamente en busca de trabajo en la esquina de la ruta 1 y Longview Dr.
(lugar de la tienda 7 eleven), en dicha comunidad. Los 12 trabajadores (mismos que no pudieron presentar identificaciones) fueron referidos a autoridades federales para su deportacion, los trabajadores restantes deberan presentarse en la corte el proximo 29 de noviembre bajo cargos de loitering o holgazanear. En sus propias palabras los trabajadores refirieron los hechos en su comunicado de prensa del pasado 22 de octubre : ... en este sitio nos reunimos todos los dias trabajadores inmigrantes que ofrecemos nuestro trabajo a contratistas y vecinos del condado... con lo que ganamos tenemos que alimentar a nuestras familias...muchas veces , abusando de nuestra condicion los contratistas no nos pagan, mas adelante anaden: ...la parroquia vecina del 7 eleven nos ha permitido usar su espacio para buscar trabajo y reunirnos, estamos organizados como el Comite de Trabajadores de Woodbridge, un proyecto de la Organizacion Mexicanos sin Fronteras. De esta forma nos esforzamos para promover y defender nuestros derechos humanos, para conseguir trabajo, para superarnos personalmente con clases de ingles, campanas de salud, de documentacion e informativas, con el fin de dignificar nuestra vida y contribuir al desarrollo y bienestar... El comunicado agrega que: algunos de los trabajadores fueron detenidos en la propiedad de la parroquia y conducidos al 7 eleven para arrestarlos. Concluyen: aun cuando hemos tenido reuniones directas con la policia y otras organizaciones del condado a quienes les hemos presentado nuestro proyecto, la policia opto por la represion y la violacion de nuestros derechos... que la constitucion de los Estados Unidos de America nos otorga...estamos exigiendo la inmediata liberacion de nuestros companeros trabajadores, la anulacion de los cargos a quienes se les dio tickets para corte, demandamos al congreso de Virginia la derogaciуn de la Ley HB 570 y del Loitering por ser concepto inconstitucional que permite su uso indiscriminado contra la sociedad especialmente cuando se dirige a grupos especificos como la comunidad inmigrante porque estamos seguros que buscar trabajo no es un crimen o delito.

En Julio del 2004 y como un desalentador ejemplo del sentimiento anti-inmigrante que se vive en los Estados Unidos el senado estatal de Virginia aprobo la propuesta HB 570 que permite que todos cuerpos policiacos tengan la autoridad para hacer cumplir las leyes de inmigracion...mediante el arresto y la detencion de ilegales... Esta ley ( homologa en intencion de la propuesta federal conocida como Clear Act ) que encubre su enganosa piel bajo la retorica de persecucion de criminales no tiene nada que ver con los hechos acontecidos a los trabajadores de Woodbrigde ni con las subsiguientes declaraciones de la policia del condado, especificamente del capitan de policia Tim Rudy que acepta que tras los arrestos se usaron huellas digitales para identificar los trabajadores que segun su version tenian violaciones de inmigracion y y por eso es que llamamos a Inmigracion...eso es solo un buen trabajo policiaco anadio.

El lenguaje oficial de apenas hace unas semanas en que publicamente la policia local y estatal, incluyendo algunas organizaciones progresivas pro-inmigrantes prometieron que esta ley no se aplicaria indiscriminadamente contra inmigrantes, permitio que la comunidad, no solo de este poblado si no de todo el estado fuese engaсada. Apuntado por Ricardo Juarez, de Mexicanos Sin Fronteras y representante del Comite de Trabajadores : ...los arrestos contradicen la promesa publica hecha por los jefes de la policia estatal de Virginia, quienes se comprometieron a no aplicar la ley indiscriminadamente contra inmigrantes que fueran inocentes de cargos criminales, Es una trampa perversa que en este contexto antiinmigrante , en el que se nos niegan las Licencias de conducir, las Identificaciones, y la Residencia Permanente a los indocumentados, se refuerza mortalmente la vigilancia en las fronteras, y se insiste en relacionarnos con la delincuencia y el terrorismo, hace evidente que a los inmigrantes se nos cierran las puertas para dejarnos en la ilegalidad y asi justificar la represion....
ninguno de los arrestados estaba en posesion de drogas o alcohol y ninguno era miembro de pandillas, su unico crimen fue buscar empleo.

Paradojicamente el condado de Prince William donde el 14.5 \% de la poblacion es hispana y que ha tenido un crecimiento del 182.9\% durante la decada pasada, ha tambien experimentado por tercer ano consecutivo una reducion en el indice de criminalidad segun el reporte anual del Departamento de Policia del Condado, presentado en mayo de este aсo. Este es el indice mas bajo de criminalidad que hemos tenido en un significante numero de aсos expreso el Jefe de la policia del condado Charlie T. Deane, quien no hizo mencion de que en la misma cantidad de aсos la poblacion del condado ha crecido un 21.5\% , debido mayormente a la poblacion inmigrante, especificamente la de origen hispano.

Ante tal escenario nosotros El Comite de Apoyo a Jornaleros e Inmigrantes de Freehold, New Jersey que experimentamos en nuestra comunidad ataques similares por parte de las autoridades locales tendemos un puente de solidaridad con nuestros hermanos y hermanas de el poblado de Woodbridge, nosotros tambien inmigrantes sin fronteras pero con muchos hogares hemos sentido en carne propia los abusos que han sufrido nuestros hermanos encarcelados y las repercusiones que esto traera a sus vidas y a la de sus familias, nosotros inmigrantes de diversos paises, inmigrantes de las tres Americas, inmigrantes que somos una pieza esencial para la vida de este pais, hacemos un llamado a todos los demas Inmigrantes en los Estados Unidos, a todos los Trabajadores Jornaleros de los Estados Unidos, a todos los individuos y organizaciones que trabajan por los Derechos de los Inmigrantes y a todos los ciudadanos de los Estados Unidos a apoyar la lucha de los trabajadores inmigrantes de Woodbridge y que sus demandas sean cumplidas; que los hermanos jornaleros arrestados sean puestos en libertad inmediatamente y que los cargos sobre los demas companeros sean anulados, que se establezca un dialogo directo con los afectados y su organizacion sin intermediarios. Tambien que las ordenanzas de loitering sean declaradas en Virginia inconstitucionales como en otros estados por ser una herramienta de discriminacion contra grupos minoritarios, ademas que haya una luz de alerta sobre las leyes parecidas a la HB 570 que en diversas formas y manifestaciones empiezan a oscurerecer el panorama de todos los inmigrantes a lo largo y ancho de la nacion.

La huelga declarada por los mismos trabajadores es un ejemplo de valentia y determinacion que nos recuerda que en la fuerza de trabajo esta nuestro poder de lucha. En tiempos en que los candidatos presidenciales de los partidos mayoritarios hacen campana politica con nuestra necesidad en debates nacionales y donde aceptan que hay que poner un remedio al obsoleto sistema migratorio que desde hace 18 anos tiene a un pueblo en cautiverio y a millones de familias divididas, es preciso decir Ya Basta! a este estado de sitio y miedo en que viven nuestras comunidades.

Unimos nuestra voz a la demanda de Libertad inmediata y anulacion de cargos para los trabajadores inmigrantes arrestados en Woodbridge, VA

Que se declaren las ordenanzas de loitering inconstitucionales tambien en el Estado de Virginia!

Que se anule la HB 570!

No al Clear Act ni a las propuestas legislativas anti-inmigrantes!

NO MAS al abuso sobre los trabajadores inmigrantes!

NO MAS a los departamentos de policia cumpliendo funciones de Inmigracion!

NO MAS a la aplicacion discriminatoria de las leyes!
