WE, the undersigned citizens of the State of Florida, hereby ask the Governor of Florida, Jeb Bush, to call for an immediate independent and bipartisan commission to be formed to investigate the events and circumstances of the tragic abduction and murder of Carlie Bruscia, age 11, of Sarasota. The purpose of the petition is to inquire specifically why the charged person, one Joseph Smith, was allowed to be in the general public despite his prior history, especially regarding a kidnap of another person prior to Carlie Bruscia s murder. The judicial system was derelict in its duty to protect the public from people like Mr. Smith, and the State of Florida has a right to correct such injustice. The citizens of Florida have an inherent right to protect their children, and the Government of the State of Florida, being of the citizens of Florida, has an inherent right to protect the children of this State from harm at any cost.
FACTS ABOUT THE PETITION
Carlie Bruscia was walking home at or around six oclock from a friends house on February 1, 2004. The suspect in the case, one Joseph Smith, was at a car wash that was when young Carlie walked through the parking lot to get home. The surveillance camera caught the moment when young Carlie was snatched by Mr. Smith, and Carlie disappeared. A search ensued, and on Friday, February 6, 2004, young Carlies body was found near a local church. Mr. Smith was detained on February 3, 2004, in connection with the abduction, and later charged with the murder of young Carlie. It was later revealed that Mr. Smith had been in and out of prison multiple times for other changes, ranging from cocaine possession to another kidnap crime, much the same way in which young Carlie had been abducted. In addition, the local judge who had heard Mr. Smiths case in December, Judge Harry Rapkin, refused to jail Mr. Smith for not paying his court costs and fines with respect to crimes he had been charged with in the past.
OBJECTIVES OF THE PETITION
WE, the citizens of Florida, in view of the above said facts, ask the Governor of the State of Florida, Jeb Bush, to undertake the following actions:
1.) Call for and establish an independent and bipartisan commission relating to the events and circumstances surrounding the abduction and murder of Carlie Bruscia and better guidelines for the use and application of the Amber Alert System.
2.) Call for the commission to be bipartisan, and should include experts and advisors that are knowledgeable regarding the current state of the law in Florida regarding criminal justice, recidivism, and the protection of children from pedophiles and other related areas.
3.) Call for the Florida Legislature to implement new and tougher laws regarding pedophiles and other related criminals that are repeat offenders or otherwise, and to implement such legislation without delay.
4.) Call for the criminal justice system to deal with pedophiles in a more uniform and stringent fashion, and to give the Florida Bar the power to convene disbarment proceedings against any judge that derelicts their sworn duties in dealing with pedophiles, recidivists, and other sex offenders before their courts.
5.) Call for other states to immediately adopt similar measures in their states, and to call for a federal version of Megans Law in terms of immediate notification of pedophiles, recidivists, and other sex offenders and more stringent accountability of the whereabouts and activities of the pedophiles, recidivists, and sex offenders.
WE, the citizens of Florida, ask these measures for Governor Jeb Bush of Florida to consider. We ask Governor Bush to not forget the children of this State, and that action on these points is taken immediately and without delay. We believe in the safety of our children, and that they should have an inalienable right to be safe from any known recidivist, pedophile, or sex offender. It is our hope that through your signatures, we can convince Governor Bush to act to protect the future of Floridas children.
