We, the undersigned, formally express a number of concerns about the ruling in this case and its implications from this point forward.
The ruling makes it possible for city officials in conjunction with other private developers to seize privately held property from citizens for the purpose of private economic gain. This separation from the previous law that granted that permission only in instances where the proposed development would better the community or public good, represents a major shift in the balance of rights and protections against families and small businesses while favoring larger businesses, consortiums and wealthier investors in legally seizing land from under the feet of its original owners.
In our opinion, this represents criminal theft by conversion, whereas the state is functioning as a broker for wealthier private investors without being obligated to pay the original owner fair market value of the assets. The state then offers the property to the private developer for profit.
Also, this ruling gives an unfair advantage to larger businesses that are now able to purchase their rivals property instead of competing against them in the market or industry.
Finally; and most importantly, the impact on the American family will be hardest felt on those families who earn less money than the outside developer who Simply can out-spend the original owner.
It is our goal to have the Supreme Court revisit this ruling and overturns it.
