We are writing on behalf of Mr. Gregory Van Alstyne, convicted of robbery and murder.
Mr. Van Alstynes personal history is tragic. This man, whom the State of Texas is preparing to execute, was both run over by a truck and struck by lightning as a young child. He later suffered from severe mental problem, and the Texas Mental Health Authority twice admitted him for treatment.
Mr. Van Alstynes defence counsel never requested psychiatric assistance for the penalty phase of the trial, nor did they mention his mental health history. In 1988, he admitted himself into a mental health centre and told the personnel that he was afraid of himself. The jury never heard learned this information, which would serves as critical mitigating evidence, during his initial trial.
Mr. Van Alstyne confessed to playing a part in Mr. Atkinson murder, questions concerning his co-defendant Ricky Allens involvement still remain unanswered. Mr. Van Alstyne argued on appeal that the prosecution withheld evidence that would have further implicated Allen and contradicted his testimony, which the State used against Mr. Van Alstyne and this is a violation. The court denied all his appeals, pointing of the overwhelming evidence against him in his initial trial. For these reason we respectfully ask you, Governor Perry and Members of Board of Pardons and Parole to stop the execution of Mr. Van Alstyne and to grant to him the executive clemency.
