Dear Mr. Tomczyk,
As I'm sure you know,it has now been almost 2 years since the Reserve has frozen the assets of the individuals in the RYPQX Fund. By no small coincidence, 98.5 \% of the individuals in this fund were TD Ameritrade clients.
To date,approximately, 94 \% of the funds (without interest) have been returned to the Fund investors. In a recent post by the Reserve, they have clearly stated that they have no intention of returning the remaining funds as they plan on using our remaining funds for their management fees and for their legal fees in fighting the suits brought against them by RYPQX shareholders.
The fact that they are using up "OUR" remaining funds for such purposes is highly ironic. To get management fees for such blatant mismanagement of the RYPQX fund is almost humerous if it were not for the fact that so many of us sustained significant monetary loss at the hands of their incompetence. In addition, the Reserve being allowed to use "OUR MONEY for "their defense funds" is incomprehensible.
Based on direct (tape recordings, witnesses) and indirect information (multiple clients that confirm TD's misrepresentations in selling the fund to it's clients), we now petition TD Ameritrade to step up to the plate, and make it's clients whole for the remaining monies which the Reserve has stated they will not return to the RYPQX shareholders.
There is also information which has now come to light that TD Ameritrade did already reimburse some selected RYPQX victims.
If we fail to hear from you within 14 days of the date of this petition, we will assume that you agree with the above, and that you refuse to take ownership and resultant responsibility for your role in the deceit which led to monetary loss to 1000's of previous loyal and unsuspecting clients of TD Ameritrade
Failure of TD Ameritrade to take responsibility for their major role in this RYPQX "hoax",will result in our taking our efforts to the "next level". After all, if it were not for TD Ameritrade, this entire fiasco which all of us have endured for 2 years now would never have occurred.
