In recent years, both the President and Congress have proposed, and in many cases, approved, legislation that increases the bureaucratic burden upon state governments and makes them agents of the federal government, which is, in fact, the reverse of the Framers intent.
The purpose of this petition is to encourage the members of both the Virginia House of Delegates and the State Senate to pass a resolution supporting the Tenth Amendment and reading akin to this:
WHEREAS the Tenth Amendment to our Constitution states, The powers not delegated to the United States by the constitution, nor prohibited by it to the states, are reserved
to the states respectively, or to the people, thereby limiting the scope of the federal government;
WHEREAS the federal government has acted in violation of this amendment, passing numerous pieces of legislation imposing undue regulation upon and removing constitutionally-protected power from the states;
WHEREAS the United States Supreme Court in 1992 ruled in favor of the Tenth Amendment in the case New York v. United States, deciding that the federal government cannot commandeer the lawmaking and regulatory processes of the states;
BE IT RESOLVED that the General Assembly and the Commonwealth of Virginia reclaims its sovereignty as guaranteed under the Tenth Amendment to the Constitution. Furthermore, the Commonwealth urges the federal government to cease and desist in the passage and implementation of compulsory regulations immediately, and begin the repeal of that legislation forthwith.
