In October there was the court hearing at the Napier Family Court. The decision was very strict and unfair to me relating my daughter Yeva. I wanted to appeal or variation or discharge of this order according to current Court order. My lawyer refused it however I find that it’s a violation of my civil rights. I also found major discrimination from the Judge towards myself.
My daughter has lived with me four and a half years and I was the primary caregiver and she only seen her father a number of times. Once, she was so afraid of him, she became extremely nervous and stressed. It took six month to rehabilitate her.
On 23/12/2010 my daughter was taken by Police and given to her father, she was very scared and screamed and cried. I am very concerned about her mental wellbeing.
I believe that all of this is harming my daughter and she should not be separated from her mother. She is very close to me. I am worried she will mentally break living in an environment she is not used to.
In addition, her father is a sailor and most of the time he spends is at sea and my daughter has to stay with his partner. I am her mother and I am banned from all kinds of contact also the little girl was taken away from her brother and they have no opportunity to communicate.
I am appealing to the New Zealand Judicial System for justice to be done whereby I may be allowed both communication and access, and custody of my (4 years 10 months old) daughter Yeva Ustyuzhanina
I believe that previous Judge did not give a fair voice that is why I am asking to change the Judge.
