Petition:To: President George W.Bush
Subject: REPEAL of the USFSPA ( Public Law 97-252 )
1. The undersigned, all being interested in Equality, and Respectfull Treatment of our Military Retiree's, request that you, as Commander in Chief, and President of the United States, correct this travesty of justice which has been created by Public Law 97-252.
2. It is the position of the undersigned that this law , Public Law 97-252, is in direct contravention of the United States Constitution (Art 1, sect 9 and 10) as well as being of guestionable status, under the 14th Ammendment to the Constitution, (Equal Protection under the Law)
3. The below listed case law defines the monies recieved by retiree's as income for reduced services, and thus their continued income and not an asset which should be divided by state courts. In addition, by normal definitions there is no such thing as retirement from the Armed Services, rather members are in a "reserve" status and by oath, UCMJ, and Federal Law required to maintain certain standards. Failure to keep these standards results in Discharge from their reserve status without pay and benefits.

b. Buchanan v Alexander, 45 U.S. 20
c. Public Law 79-190, Sect 4
d. USCG (US Comptroller General) Decision B-236084
e. U.S. v Taylor 105 U.S. 2444.
4. Based on the above case law, and respectful treatment of our retiree's it is hereby requested that you correct this situation, via "execuative order" or by overseeing Congressional Action which REPEALS this Law.
5. Modification to this law have been stalled for over two (2) years by the 106th Congress and the US Military.
6. In advance we thank you for your Support of this measure.
