Extradition from Massachusetts to State of Delaware for Robert D. Gabrielson
I am requesting that the Extradition to the State of Delaware from Massachusetts, be revoked. Robert was arrested on March 10, 2004 for a traffic violation, and later charged with DUI. During the traffic stop, an NCIC hit was found on Robert having a warrant for him out of The State of Delaware. The warrant was limited to 250 miles. Delaware was contacted, and they replied as not extraditing. On April 29th, Robert was offered an Plea agreement in Massachusetts on his DUI arrest, his decision to take the plea agreement was based soley on the decision to extradite by Delaware. His Attorney informed the General District Court in Worcester County, Ma.
that Delaware was NOT Extraditing. So Robert took the plea deal and was sentenced to One Year Mandatory in the Worcester County Jail and House of Correction. In July, Robert was informed that Delaware has sent a detainer and Confirmation of Extraditon for Robert upon his release on March 10, 2005. The Warrant for Extradition is for Violation of Probation, Misdemeanor, Non-Violant Offense.
Robert based his decision to take a plea deal only on the basis that Delaware was not going to Extradite, and that the Warrant was limited to only 250 miles. Robert was over 400 miles from Delaware. Robert is not a violant Person, but he is much needed at home. This Extraditon is going to cost the taxpayers of Delaware. The State of Delaware is already cutting Budgets for the Medicaid Program, which is needed by the Residents of the State of Delaware, also, School Budgets are being cut, which is going to affect the Children of the State. Robert has no need or Desire to ever enter the State of Delaware again. Robert has no ties to the State of Delaware, his family is in Massachusetts. This Extradition is not only going to cost the Taxpayers money, that should be used for other purposes, but it is also going to put his family in a great Hardship.
The Detainer has also stopped any chance of Robert to be eligable for any kind of Work Release programs, that ALL DUI Offenders are entitled to. Because of this, His wife is constantly fighting a battle of becoming Homeless.
We are asking that the Extradition for Robert D. Gabrielson be Denied, so that on March 10, 2005 Robert will be released and and remain in Massachusetts with his family where he is desperatly needed. Thank you.
