Support the right of refuge for two Iranian female refugee seekers in Turkey: Amire Fazeliniya (mother) & Nazanin Mostaghel (daughter)

موضوع: حمایت از حق پناهندگی امیره فاضلی نیا و نازنین مستقل پناهجویان ایرانی ساکن ترکیه

امیره فاضلی نیا و نازنین مستقل پناهجویان ایرانی ساکن کشور ترکیه که به علت ظلم و ستم هایی که در مدت حضور در کشور ایران بر آنها روا شده و خطراتی که در کشور ایران آنها را تهدید می کرده است، مجبور به ترک ایران گردیده، و در صورت بازگشت به ایران، در معرض تهدیدات بزرگی خواهند بود.

آنها در تاریخ اول ژانویه سال 2005 میلادی، پس از خروج از کشور، خود را به دفتر این کمیساریا در شهر وان معرفی نموده که درخواست شان برای دریافت حق پناهندگی از جانب این کمیساریا مردود اعلام گردیده و پرونده امیره فاضلی نیا بسته و دخترش نازنین مستقل استیناف شده است.

وی که پس از تجاوزهای مکرر و وحشیانه یکی ازاعضای عشیره خود، تصمیم به تغییر مسیر زندگی خود داشته، پس از ازدواج با شخصی خارج از عشیره اش و بواسطه سرپیچی از قوانین خشک و متحجرانه عشیره ای، پس از تهدیدهای مکرر از جانب اعضای عشیره خود و توطئه و انتقام جویی ایشان، با اتهام سراسر کذب و بی اساس جاسوسی دستگیر و روانه زندان های مخوف رژیم جنایتکار جمهوری اسلامی شده، و در صورت استرداد به ایران، در معرض خطر مرگ از جانب اقوام و عشیره خود و رژیم جمهوری اسلامی قرار خواهد داشت. وی هم اکنون نگران سرنوشت خود و دختر نوجوانش می باشد.

متاسفانه ایشان قربانی قوانین ظالمانه و غیرانسانی که در میان برخی از قبایل سنتی ایران همچنان رایج است شده اند، که با روی کار آمدن رژیم جنایتکار جمهوری اسلامی و تسلط قوانین تبعیض آمیز اسلامی نیز، این قبایل آزادی عمل فوق العاده بیشتری برای توجیه این جنایات به دست آورده، و حق هرگونه اعتراضی را از قربانیان خود گرفته اند.

ما امضاء کنندگان این نامه، با شهادت بر صحت اظهارات ایشان، خواستار بازگشایی و بازبینی پرونده این پناهجو و اعطای حق پناهندگی در برابر ظلم و ستم و خطر اعدامی که در صورت بازگشت به کشور وی را تهدید می کند، به ایشان می باشیم. و صراحتا تاکید می کنیم که در صورت استرداد وی به ایران، ایشان در معرض خطر مرگ قرار خواهد داشت.

SUBJECT: Support the right of refuge for two Iranian female refugee seekers in Turkey: Amire Fazeliniya (mother) & Nazanin Mostaghel (daughter)



The above mentioned individuals (mother and daughter) both Iranian national have a considerable sad and horrifying story of what had happened to them in Iran just a few years ago.

Amireh (the mother) who belongs to a tribe in southern Iran, as the result of her refusal to accept the bitter fate drawn out by her tribesmen, was subjected to repeatedly mental and physical tortures as well as rapes. But, in the contrary to all those scary punishments and horrifying tortures and harassments as well as inhumane acts and tyrannies by her tribesmen intending to make her to obey those inhumane rules, she was eventually able to rescue herself and move to Tehran and marry a man of non tribe as well as to continue her education for a degree.

Despite her independent life in Tehran, Amireh had become a target of various severities and revenge by her tribesman whom were enjoying full support from the Islamic Republic authorities. Thus, as the result of their inhumane revenge, Amireh was innocently alleged to be involved in an espionage activity and was therefore arrested by the Ministry of Intelligence of Islamic Republic of Iran and detained in Evin prison of Tehran to suffer many more inhumane and unbearable tortures and violence there.

It was in January 2005 that, Amireh took advantage of her temporary release from Evin prison and therefore together with her daughter (Nazanin Mostaghel) they had crossed the boarder lines and entered Turkey where they both took refuge to UNHCR office in city of VAN hopping to safeguard their lives and have a descent life in a free and democratic country anywhere in our big universe.

Unfortunately after several years of suffering harsh living conditions for refugees in Turkey, the case for Amire Fazeliniya (the mother) have been denied by the UNHCR and was therefore closed, but the case for Nazanin (the daughter) is still under appeal by the UNHCR authorities.

At present, these two innocent and unfortunate Iranian female not only suffer all those harsh living conditions but also they are under constant mental harassments and fear of being deported back to Iran where they know they will receive nothing but further tortures , imprisonment and possible execution by the Islamic Republic regime.

Therefore, we undersigned bellow, whilst confirming the trueness of all that had happened to Amireh Fazeliniya in Islamic Republic of Iran we also verify all those inhumane behavior done by the Islamic Republic of Iran against Amireh Fazeliniya.

In the meantime we do clearly indicate and hereby do ALERT the world opinion and particularly the UNHCR and especially all related human rights activists as that the return of Amireh Fazeliniya to Iran will certainly put her life in jeopardy and bring her nothing but at least a long term imprisonment together with inhumane tortures or an execution sentence. Therefore, we undersigned bellow do hereby ask all human rights activists to help these unlucky mother and daughter and assist Amireh Fazeliniya to proceed another appeal to UNHCR.

Finally and more importantly we hereby do ask the UNHCR in Turkey to reconsider Amirehs case intending to recognize basic rights of living for this unfortunate Iranian woman. We declare once again and very clearly that the return of Amireh Fazeliniya to Islamic Republic of Iran will certainly destroy her life or at least her freedom.
