U.S. Residents Demanding the Return of Our Constitutional Rights

We, the following U.S. Residents, demand the return of our constitutional rights. These rights have been and continue to be steathly, systematically and progressively destroyed by the 3 branches of the U.S. Government. The guise of PRE-protection of some citizens is the basis for unsubstantiated, sometimes false, accusations being allowed to libel, slander, financially destitute and criminalize some innocent people without due process or other constitutional checks and balances being implemented.

On the following issues we demand reform:

Divorce Rights:
We demand the rights of each parent and the children's rights to each parent be upheld and become the STANDARD in divorce rights via shared parenting or joint physical custody. We request that proven false allegations be considered as detrimental to the child and acted upon by the judiciary.

Domestic Violence Rights:
We demand EQUALITY in the applications of this law, with the requirement of proven facts, subject to due process PRIOR to ANY penalties being enforced on the accused. We also demand the removal of financial incentives for agencies to 'find' and 'make' abusers and the removal of immunity for false accusations by accusers.

Child Protection Rights:
We demand that the abuses of children be real, documented proven facts, subject to due process, PRIOR to removal to potentially UNSAFE OR DEADLY foster homes. We also demand the removal of financial incentives to govenment agencies to 'find or make' abusers and the removal of immunity from those agencies and accusers.

Judicial/Government Rights:
We demand that all courts decisions regarding remedies, restraints, penalties are based equally, regardless of gender, and that existing perjury and filing false accusations be enforced when proven in all cases. Further, we demand that all subversive teaching of unconstitutional handling of court cases be stopped, rescinded and become compliant with the constitution. We request that judicial accountability become standard and that immunity be removed in regards to criminal acts. Further, we request, that when an official is found to use his office for criminal acts that their pensions also be denied.

Penalties for Noncompliance with Demands:
From now, until all demands are met, a vote against ANY of the demands listed WILL RESULT IN A VOTE AGAINST THAT INDIVIDUAL RETAINING OFFICE, REGARDLESS OF ANY OTHER POLITICAL STANCE.

Requests will be dealt with should we ever attain the lofty and (without public activism) unattainable goal of 5 million signatures.

The constitutional rights of thousands of Americans are being discarded on a daily basis. Those that fall prey to their jurisdictions, find that not only have their rights disappeared, but, concurrently, they are labeled a bane to society in the same instant in an effort to keep their rights from being backlashed or exposed by the public. Political Correctness, pompous pre-protection legislation, judicial unaccountability and self potentiating destructive agendas have replaced the virtuous deliberations of our noble fore-fathers and founders. The efforts these original patriots made to create a permanent system of checks and balances to insure the freedoms and rights for all the descendants of their country have been usurped.

NO WAY? YES, WAY!

DIVORCE LAWS

Every year there are 1 million divorces and the numbers are climbing. In at least 80\% of these cases with children the rights of fathers and their children are being denied. In most of the remainder, the mother's rights are removed. One parent is made a 'visitor and financial supporter' whose contact with their children, AT BEST, is usually cut to 14\% of their previous contact with their child and usually very little or no parental authority over the general aspects of the predominance of their child's care and developement. At worst, there is NO contact with the Non Custodial Parent (NCP). The NCP is then levied with most of the financial burden based on a strict and stringent percentage of the last 3 years of GROSS income.

If you lost your job prior to going to court for your levy, you are 'underemployed' and still assessed support on what you made last year. If the recession has caused you a salary cut or to be fired, you are 'underemployed' and still responsible for the full amount of child support. If you have been sick, or in a battlefield, or a POW, or in jail and are unable to file for a decrease in child support. Even if you are lucky enough to get a reduction, 5\% or less of NCPs are given reductions in child support after 15\% or more decreases in salary, there is a law in place that prevents anyone from removing the back child support owed. Are you able to pay, want to pay and have paid 3/4 or 15/16 or 99.9\% of what the court has decided you are to pay, BUT, DO NOT PAY THE FULL AMOUNT, you are a 'DEADBEAT' and will have your license revoked, arrested, incarcerated and will be an official criminal. More than likely, you have lost your job, and now, you get to look for one with the added 'advantage' of being a criminal. All the while you are in jail, looking for a job, or even paying partial support, the levied 'child suport keeps adding up, along with 8\% interest. Not surprising, is the fact that of the total monies the government states is owed by 'DEADBEATS' is the fact that 15\% of the total is owed by the DEAD, more than likely driven to suicide by this system.

Only shared parenting, a split of the children's parental time of 50/50, can help alleviate this problem. It maintains the constitutional rights of each parent to their child and the constitutional rights of the child to each parents protection and development. Shared parenting is also the only thing that has DECREASED the divorce rates in the few states it has been used. Presumably, by decreasing the financial gain and vindictiveness of the custodial parent. It also removes the harsh and sometimes unattainable levies of the court for the NCP because both parents become responsible for the finances of the child while in their care. Thereby, saving BILLIONS of dollars of tax money being used to make criminals out NCPs and trying to collect monies that are just not there.

DV LAWS

Every year there are 1.5 to 2 million restraining orders (ROs) placed on individuals and the numbers are climbing. In divorce circles, these are called the 'silver bullet'. In NCP advocate groups, they are called a 'death sentence'. They were promoted and used in domestic violence. In the state of MA, there were 36,000 ROs placed in 2000. 71\% of these orders placed NOT on abuse, nor even the claim of abuse, JUST THE 'FEAR' OF ABUSE. Their effects are severe. More than likely, once someone states 'They are 'afraid', most or all of these will apply:
No contact with your children, removal from your home, placement on a permanent database as an 'abuser', weekly pre-probationary and court appointments, anger management classes, curfews, inablility to consume alcohol legally, removal of possession of any firearms or 'other weapons', inability to visit anyone with a firarm or 'other weapon' in their residence, admitting to an offense you did not commit, drug testing, electronic monitoring, mental health evaluations, no contact with the 'victim' of the accused violence, no contact with any witness, family of the 'victim' or any location at which the victim may be found. Any of these will very likely cost the accused their job. All of these are done BEFORE YOU GO TO TRIAL for the accusations. If the accused is caught doing any one of these violations, the violator goes directly to jail for up to 5 years (minimum for a firearm violation) WITHOUT a trial. If you have been accused falsely, vindictively, you may just decide to imprison yourself in your NEW residence.

Just deciding you are going to accept these unconstitutional decrees does not keep you from going to jail. There are multiple cases in which accidental meetings, or well intended circumstances, may put the accused there anyway. There are documented cases where a parent called his child on the wrong day of the week. Or, wrote a note to inform the other parent of a childs illness. Or, passed the 'victim' on the other side of an interstate going in the opposite direction. Or, sent their child a birthday card. Or, the parent got out of their car to assist their child. All resulted in prison sentences.

Any man, with any woman, in any situation where there is no other witness or documentation of what transpired during that time is in GRAVE potential DANGER of becoming an 'abuser' or a 'rapist' just by a mere unsubstantiated accusation. The documentation will keep you from being convicted, but, it will not keep you from being arrested and placed in any or all of the pre-trial requirements of 'domestic violence' complaints. One woman in Sacremento was blackmailing 8 different men under threats of prosecution for rape, some of whom there had not even been any intimate contact between herself and the victims.

Domestic violence (DV) and sexual assaults need to be stopped for both sexes, applied equally and based on real, documented, proven facts subject to due process, for those are our and our children's constitutional rights. Not based on a subjective feeling or an unsubstantiated or false accussal of being 'afraid' or abused.

CPS LAWS

Every year there are 3 million families affected by Child Protection Services (CPS). Child protection works very similar to RO abuses. In each situation, all that is required to remove your rights to your children is a simple accusation. This accusation can be either a misunderstood caring circumstance or the deliberate vindictive application of revenge. Since, like ROs, the states get reimbursed for the number of children 'they protect' they have a biased interest in protecting as many children as possible. But, CPS, also gets BONUSES for going above their 'quotas'.

Before the parents are even allowed to 'prove' their innocents, the children are removed from them. In some cases, the events that befall these children as wards of the state are far more horrible than anything the parents are accused of.

Government agencies need to remove children in abusive homes. But, those abuses must be real, documented, proven facts subject to due process for those are our and our children's constitutional rights. Not based on an unsubstantiated accusation and interpreted by government agencies which are immune from liability and gain financially from each case they 'find'.


JUDICIAL BETRAYAL

Every year the judicial system promotes gender biased applications of laws on thousands of real criminals. But, it is a common fact, and not even disputed, that the length of time for sentencing almost always produces a far lesser sentence for a female for the exact same crime a male did. Even in cases as severe as rape, perjury and false filing of criminal charges is routinely not persued by prosecutors. In fact, in DV, CPS, and RO cases, there is immunity for the false accuser, even if they admit the lie or the lie is proven beyond the shadow of doubt (which is very rare, since usually, its a he said, she said, deal unless you happen to have 24/7 video and audio surveillance). Judges are being trained to subvert the constitution.

LEGISLATIVE AND EXECUTIVE BETRAYAL

In the last 38 years while federal legislators have been busy destroying the constitution and distracting the public with pre-protection agendas, they 'somehow' managed to increase their salaries by 1,240\% (One thousand, two hundred and forty percent). Their total benifits when retirement is added in is probably closer to 2000\% (Two thousand \%), all from the tax dollars of the citizens whose rights they are incrementally destroying by passing laws which are clearly unconstitutional.

PUBLIC BETRAYAL

STOP THE APATHY, BECOME ACTIVE AND TAKE BACK OUR CONSTITUTIONAL RIGHTS FROM THESE SNEAKY TRAITORS OF THE CONSTITUTION.
