Detective Richard Morrell committed perjury during a felony trial, fabricated incriminating evidence in police reports and coerced the victim during photo lineup.
These allegations can be proved by:
l. Signed sworn affidavits from witnesses; Joe Adams, James Tucker,
Mary Rollins, Mary Stock, David Stock and Tracie Metz.
2. Depositions taken during trial of James Tucker.
3. Taped recorded interview between Joe Adams and Charlene Sumpter.
A private investigator, Joe Adams, was hired after the trial. He had an opportunity to interview the victim, Charlene Sumpter. This interview was recorded with her permission. During this interview the victim, Ms Sumpter stated the following: It was dark that night, it happen so fast, all blacks look alike to her and she was unable to identify anyone. Ms. Sumpter then stated that Detective Morrell asked her to pick one of the people in the photo line up. After Ms. Sumpter pick #3, Detective Richard Morrell points to #5 and states, this is the guy, Darrell Devine who took your purse. It is important to note that two of Ms. Sumpters friends where present at the time of the interview between Joe Adams and Ms. Sumpter. Mary Rollins & Mary Stock have both signed affidavits stating that Ms. Sumpter was unable to identify anyone.
Detective Morrell committed perjury during trial when he testified he did not show the photo lineup to a second witness, James Tucker. Mr. Tucker stated he was shown photos by Detective Morrell in a deposition and an affidavit. Detective Morrell committed perjury when he testified that the persons he talked to all had amnesia about the phone calls they received from the stolen cell phone the night of the robbery.
Tracie Metz signed an affidavit stating that she told Detective Morrell who called that night, why they called and she knew no Mr. Devine.
It is because of these alleged criminal activities of Detective Richard Morrell we request a Federal Grand Jury Investigation. Respectfully submitted.
