This is a PETITION to the TOWN OF SMITHTOWN from and by the Residents and Taxpayers of the Town who are either on the Town's "Curb Repair List" or may- at some time in the future- find themselves on said list.
WHEREAS, the Town of Smithtown has a legal obligation to maintain the curbs in front of residential homes that are located within the Town; and
WHEREAS, the Town of Smithtown maintains a "Curb Repair List" for the purpose of scheduling and effecting said repairs; and
WHEREAS, the Town takes an unreasonable amount of time to effect needed repairs... in many instances, numerous years; and
WHEREAS, unrepaired curbs can pose a safety hazard to the public and can affect personal real property, including the resale value of our homes, and increased homeowners insurance claims; and
WHEREAS, crime studies, such as the "Broken Windows" Theory, show that whenever a neighborhood begins to look run down, this sends a signal to undesirables to move in and can result in an increase in crime rates,
NOW, BE IT HEREBY RESOLVED that we, the undersigned Taxpayers and Residents of the Town of Smithtown, demand an immediate dedication of resources to curb repairs; and
BE IT FURTHER RESOLVED that we demand the Town immediately speed up and effect said repairs;
BE IT FINALLY RESOLVED that a copy of this PETITION be filed with the Town Board, the Town Supervisor, the Town Attorney, the Town Highway Department and local media.
