James was sentenced on Wednesday 6th March at Crown Court to 12 months in Prison for having underage sex with his girlfriend. The 2 counts of illegal sexual intercourse occurred between June and September 2010, when he was 17 and she was 14. They had been in a relationship for 12 months prior to that and the relationship continued until March 2011.
I would like you to know that technically James broke tha law. However when the law was drafted and in subsequent guidance by the justice department and the crown prosecution service, it says that it was not meant to be used to stop teenagers, who are close in age, engaging in consensual sexual activity. That it would not be in the public interest to prosecute in such cases. Further the guidance to judges in sentencing is a 12 month suspended sentence or other lesser sentence for the crime that James has committed.
In summary he should never have been prosecuted and he certainly should not have been committed to prison.
