To Whom it My Concern;








John Giuca turned 22-years-old on October 8th, 2005. He has spent the better part of his 21st year behind bars for a crime he did not commit. Now, after being found guilty on charges that had absolutely no supporting evidence, John faces 25 years to life in prison.





We are here today to tell a different story; a story not told by any of the newspapers or other media. The public needs to know about the corruption that has been going on in the case of the death of the young college student, Mark Fisher.





Mark Fisher was 19-years-old in October of 2003 when his life was tragically ended on a quiet Brooklyn sidewalk. It took police and prosecutors two years to find enough evidence to take his case to State Supreme Court.


Detectives, calling themselves the dirty-tactics squad took personal offense to people using lawyers and began a campaign of highly unorthodox investigation which included threatening witnesses to create a false story. Strategically placed $100,000 reward signs lured people to offer information and everyone EXCEPT the people who knew John the best, like his own brother, was subpoenaed.





Prosecutor Nicolazzi picked only a handful of so-called witnesses out of the approximated 150 people subpoenaed to testify in a grand jury for the trial. The credible witnesses chosen consisted of a college student on probation for assault, an ex-


girlfriend who was threatened with losing her job, a self-admitted career criminal who takes pills prescribed for schizophrenia, and a college student who had been under the influence of alcohol and drugs the night the murder occurred. Those are the facts---those are Nicolazzis credible witnesses; simply proof that there was NO case against John Giuca---simply pathetic speculation.





John Giucas jury took TWO HOURS to decide his fate. He was found guilty of providing the gun that killed Mark Fisher as well as with robbing him. Ladies and gentlemen there is NO substantial evidence proving his guilt. NONE at all. There was no weapon found and all the jury had to go on was the conflicting testimony of poorly chosen witnesses. The medias misguided portrayal of John from the very beginning of the case could have influenced the verdict. Shouldnt the widely ignored phrase innocent until proven guilty apply to the media as well as to the justice system?


Only one man was responsible for Mark Fishers death. That man is not John Giuca.


John is a brother, a son, and a loyal friend. Hes not the monster gang leader the media has made him out to be. Were asking you to read between the lines and realize that the case against Mr. Giuca is based on false and rehearsed testimony.





We are not asking you to agree with us that he is innocent; all we are asking is that you sign this petition showing that you agree that there needs to be a re-evaluation of the evidence and witnesses in this case. Please help this cause. This can happen to anyone; this time, it happened to be our brother. Help us show Judge Marrus, who has presided over this case, to re-evaluate the jurys decision.
