We, the undersigned, are outraged at the treatment of the Smoak family and the needless killing of their beloved pet by officers of the Tennessee State Highway Patrol and Cookeville Police Department. Both departments and Governor Sundquist should issue a public apology and all officers involved should be summarily dismissed. Being officers of the law does not exempt them from accountability for these actions and those involved in the killing of the Smoaks dog, Patton, should be charged with aggravated animal cruelty in accordance with Title 39, Chapter 14, Section 212. Furthermore, they should also be charged with intentional killing of an animal in accordance with Title 39, Chapter 14, Section 205 which states:
(a)(1) A person who intentionally or knowingly unlawfully kills the animal of another, with the intent to deprive the owner of the right to the animal's life and without the owner's effective consent commits theft of that animal and shall be punished under 39-14-105.
This kind of brutality must not be condoned and/or tolerated and we urge you to take decisive action regarding this matter.

If a civilian had done the same thing, he would be sitting in jail right now, charged with cruelty to animals. Police officers have the same, if not more obligation to use good judgement as the rest of us. This was bad judgement, plain and simple.
