As enumerated and guaranteed by Article 1, Section 6 of the Michigan Constitution and by the Second Amendment to the US Constitution, Every Person has a right to keep and bear arms for self-defense. This Right has been validated by two recent Supreme Court Cases.
The US Supreme Court in District of Columbia v. Heller (2008) held that the right to bear arms means "the individual right to possess and carry weapons in case of confrontation". Subsequently in McDonald v. Chicago (2010), The US Supreme Court held that this right warranted applicability against not just federal but also state regulation because bearing arms was "among those fundamental rights necessary to our system of ordered liberty. Additionally, the US Supreme Court in Castle Rock v. Gonzales (2005) held that Police Departments have No Duty to provide Protection for any Person, even if said person has a Personal Protection or Restraining Order.
The risk for confrontations does not cease to exist based on what type of building or location we are at and our right to protect ourselves does not either. We have a Right to Life and have a Duty to provide for our own Self-Protection, no matter where we are. Therefore, our Right to keep and bear arms for Self-Defense exists wherever we do.
For the foregoing reasons, We, the residents of the State of Michigan, urge the Michigan Legislature and Michigan Governor to take action in living up to your Oaths of Office and to respect the Rights enumerated and guaranteed by both the Michigan Constitution and the Constitution of the United States.
