Recently in Lorain County, Ohio, a jury deliberated for two and a half hours before reaching a verdict of guilty on ten counts of criminal activity ranging from capital murder to tampering with evidence and arson for Nicole Diar.
In the trial, NO scientific evidence was presented which directly links Nicole to having murdered her son or to having set the fire which concealed the cause of his death.
It is reasonable to presume, that given the fact that there were ten charges facing Nicole, dividing the timeline for jury deliberation reveals that less than fifteen minutes per charge was spent on deliberations.
Fifteen minutes: to presume innocent until proven guilty beyond a reasonable doubt, as is required by law.
Fifteen minutes: to review materials, including more than four hours of videotaped evidence, hundreds of photographs, as well as to consider the scientific evidence presented by the prosecution and the defense.
We the undersigned, feel that it is IMPERATIVE that in a death penalty case such as this, that the jury carefully consider the facts of the case, and not react to the emotions brought about by the death of a young child and the desire to make someone pay for having caused it. We do not feel that it is possible for the jury in this case to have considered much, if any, evidence, in returning their verdict. Their minds were effectively made up before they walked out of the court room.
In consideration of this information, we, the undersigned further request that the court set aside the jurys verdict in this matter, in order that justice be served.
