To: The above listed, Honorable California Congress members in the 107th Legislative Assembly.
Your California constituency is requesting access to a registry for the purpose of viewing records of child molesters & sex offenders online.
It is unjust and unreasonable that parents are unable to access online information that will protect their childrens lives. California does not maintain an online sex offender registry. It is irresponsible to allow this condition to remain status quo.
Within the United States of America 31 states have passed laws granting their respective constituencies access to information regarding child molesters online, and 6 other states have possible pending legislation regarding online access. The people of California deserve the same respect.
Currently we have Megans law. This law gives you access to monthly updated CDs in various California Police and Sheriff stations that hold offenses and mug shots of Registered Sex Offenders in California. That Law has a code attached to it Section 6254.5 of the Government Code which is;
Disclosure of Exempt Record
6254.5. Notwithstanding any other provisions of the law, whenever a state or local agency discloses a public record which is otherwise exempt from this chapter, to any member of the public, this disclosure shall constitute a waiver of the exemptions specified in Sections 6254, 6254.7, or other similar provisions of law. For purposes of this section, "agency" includes a member, agent, officer, or employee of the agency acting within the scope of his or her membership, agency, office, or employment.
Section (g) Of records relating to any person that is subject to the jurisdiction of the Department of Corporations, if the disclosures are made to the person that is the subject of the records for the purpose of corrective action by that person, or if a corporation, to an officer, director, or other key personnel of the corporation for the purpose of corrective action, or to any other person to the extent necessary to obtain information from that person for the purpose of an investigation by the Department of Corporations.
This code protects the criminals privacy but not the childs safety. Our governments primary concern should be the welfare of its children. Parents are requesting the tools to keep our children safe. Your signing of this petition will give you a voice that will ring loud and clear to your district representative and throughout the congressional hall. Congress members, please give us the power to protect our most precious possession our children!!!
