BACKGROUND: The owner of the property applied for a zoning variance to allow four units on a property zoned for two units (R2) without the dedicated parking spots required for the additional two units and with a four-foot side path instead of the required ten-foot side path. The owner asserts that the property has had four units for decades. The Zoning Administrator denied the variance request. The owner has appealed the denial, and Councilman Wesson is supporting the appeal.
SUMMARY: We oppose the appeal of the Zoning Administrator's decision to deny the variance requested for this property.
We believe that zoning variances like the one at issue in this case have contributed to some of the biggest problems in our area, from an excessive concentration of auto body shops along Pico Boulevard to a shortage of residential parking.
We also believe that there is nothing unique about the property that justifies a deviation from the zoning rules that were developed to ensure a safe, livable community. Indeed, this case presents one clear safety and livability issue: the residents of the two additional units would only be able to access their units by walking along a narrow four-foot side path, partially blocked by trash cans, directly outside the bedroom window of a neighbors young child. This, along with the increasing shortage of residential parking in the area, should lead the Commission to deny the appeal.
