Nahwegahbow WE, THE UNDERSIGNED: The Algonquins of Barriere Lake First Nation Members DRAW THE ATTENTION OF THE: Section 74 Band Council Elected August 14, 2012. ABL Reconciliation Committee Honorable Judge O’Neill David C. Nahwegahbow TO THE FOLLOWING THAT; The ABL Reconciliation Committee (3 former ABL Band Councils) were named as Respondents in the Interpleader Action commenced by Nahwegahbow Corbiere within the Superior Court in Parry Sound, Ontario (Court File No.CV-10-111)after being requested by the Band Council 2010 and refusing to submit all the Trilateral Agreement Files back to Algonquins of Barriere Lake for transparency purposes. On February 29, 2012, an important engagement and commitment was signed and agreed upon as stipulated within Appendix A-Terms of Reference of The Algonquins of Barriere Lake & Reconciliation Process between three (3) former Band Council. Collectively, they became the ABL Reconciliation Committee and committed to carry out the following; 1) will oversee a fact-finding process and mandate an Independent Fact-finder; specifically a Forensic Auditor who will undertake the responsibility within a fact-finding process to investigate and report within a Forensic Audit on all aspects within the Trilateral Agreement including Contribution Agreements, Financial documents, Financial receipts, Reports and Audits, Proposals, Band Council Resolutions, Correspondences, Maps, Study reports and all Equipment; disclosing how and where the Trilateral Agreement funding was distributed. 2) will undertake the responsibility to consult the highest ranking authority the Anishinabek-The People and document their recommendations regarding the amendments and process regarding modification and ratification of the Mitchikanibikok Anishinabe Onakinakewin-Governance Code. On July 28, 2012, Honorable Judge O’Neill, Michael Swinwood, (Lawyer) Graham Ragan (Lawyer) held a meeting at Le Domaine with the Algonquins of Barriere Lake and members of the ABL Reconciliation Committee to provide an overview of the Reconciliation Process, the Terms of Reference and explained a Court Order was in effect to continue the Reconciliation Process regardless of the results August 14th 2012 Elections. There have been held two (2) conference calls with Judge O’Neill to discuss the transfer of the files from David Nahwegahbow’ s office to be delivered to Deloitte, the Auditor hired by the Reconciliation Committee. Unfortunately, the transfer of files could not be accomplished due to technicalities and the subsequent participation of the new Section 74 Band Council. At the request of Chief Ratt, the matter was suspended until a new conference call on September 19th 2012. THEREFORE YOUR PETITIONERS REQUEST THE: Section 74 Band Council Elected August 14, 2012. ABL Reconciliation Committee Honorable Judge O’Neill David C. Nahwegahbow TO: Jointly within a collaborative approach for the promotion of peace, transparency and accountability agree to avoid any further delays within the Reconciliation Process and implement the terms which have already been established and agreed upon as stipulated within Appendix A-Terms of Reference. (February 29, 2012).
