The PATIENT PROTECTION AND AFFORDABLE CARE ACT has sparked tremendous debate in Texas. Out of that statewide debate a consensus is emerging in Texas that WE SHOULD NOT COMPLY with this or any other FEDERAL LAW that would DESTROY OUR ECONOMY, COMMANDEER OUR RESOURCES OR ALTER OUR REPUBLICAN FORM OF GOVERNMENT.

NUMEROUS APPEALS have been made to the GOVERNOR OF THE STATE OF TEXAS to take substantive action to uphold and PROTECT TEXAS SOVEREIGNTY by convening an EMERGENCY SESSION OF THE LEGISLATURE to produce an ORDINANCE OF NULLIFICATION to formally declare our intentions NOT TO COMPLY with FEDERAL DICTATES that would ROB US OF LIFE, LIBERTY AND PROPERTY, but the GOVERNOR has REFUSED to interpose preferring LEGISLATIVE ACTION, which if history serves us, will be SUMMARILY DISMISSED as frivolous.

As a response to the recent federal health care legislation, as well as other numerous VIOLATIONS OF STATE SOVEREIGNTY by the FEDERAL GOVERNMENT, we TEXANS CALL for a DELEGATION TO ADDRESS AN ORDINANCE OF NULLIFICATION and any other action necessary to abide by Article 1, Section 1 of the Texas State Constitution which states: TEXAS IS A FREE AND INDEPENDENT STATE, SUBJECT ONLY TO THE CONSTITUTION OF THE UNITED STATES, AND THE MAINTNENANCE OF OUR FREE INSTITUTIONS AND THE PERPETUITY OF THE UNION DEPEND UPON THE PRESERVATION OF THE RIGHT OF LOCAL SELF-GOVERNMENT, UNIMPAIRED TO ALL THE STATES.

We now APPEAL AT THE COUNTY LEVEL to call a delegation of the 254 counties of Texas to CONSIDER OUR PERILOUS POSITION; WE HAVE BEEN BURDENED WITH ODIOUS DEBT BY THE FEDERAL GOVERNMENT AND DESIRE INTERPOSITION BY OUR GOVERNMENT FOR THE POSTERITY OF TEXAS. INITIATION OF SUCH ACTION BY THE PEOPLE IS AUTHORIZED IN THE TEXAS CONSTITUTION, ARTICLE1, SECTION 2: "ALL POLITICAL POWER IS INHERENT IN THE PEOPLE and ALL FREE GOVERNMENTS ARE FOUNDED ON THEIR AUTHORITY AND INSTITUTED FOR THEIR BENEFIT. The faith of the people of TEXAS STANDS PLEDGED TO A REPUBLICAN FORM OF GOVERNMENT, and, subject to this limitation only, THEY HAVE AT ALL TIMES THE INALIENABLE RIGHT TO ALTER, REFORM OR ABOLISH THEIR GOVERNMENT IN SUCH MANNER AS THEY MAY THINK EXPEDIENT.

This action does have historical precedent. My signature indicates my consent to be represented by a delegation to be selected from among the signers of this or a similar petition TO BE CHOSEN BY A COUNTY JUDGE OF EACH COUNTY IN TEXAS OR BY SPECIAL ELECTION.

MY SIGNATURE ALSO CONSTITUTES MY SOLEMN RESOLVE NOT TO VOTE FOR ANY CANDIDATE FOR PUBLIC OFFICE IN TEXAS WHOSE NAME DOES NOT APPEAR ON THIS OR A SIMILAR PETITION FOR THE NOVEMBER ELECTIONS IN 2010.
