La decisiуn del Tribunal Europeo de Derechos Humanos de suspender la extradiciуn del criminal de guerra Yair Klein a Colombia es una pбgina negra para los derechos humanos en el mundo, favorece la impunidad de los crнmenes cometidos por el seсor Klein y sus alumnos paramilitares en Colombia, negando la verdad y la justicia para sus vнctimas. Este es un fallo que avergьenza a la humanidad, a las vнctimas y a la causa de los derechos humanos.
Los crнmenes cometidos por los alumnos del seсor Klein estбn comprobados en Colombia, su participaciуn como instructor debidamente documentada y el juicio al cual fue sometido contу con todas las garantнas procesales; si quisiera apelar ese fallo, la legislaciуn colombiana le proporciona recursos para hacerlo.
Es falsa la razуn que argumenta el seсor Klein al manifestar que en Colombia podrнa ser torturado o sus derechos humanos vulnerados. Klein y el Tribunal Europeo desconocen que en cada cбrcel colombiana funciona un Comitй de Derechos Humanos con representantes de los internos y que ademбs existe la Defensorнa del Pueblo para velar por los derechos de los reclusos.
Es una vergьenza que el instructor de los asesinos de la Rochela, de Luis Carlos Galбn, de Bernardo Jaramillo Ossa, de Hйctor Abad Gуmez, de cientos de campesinos, de decenas de funcionarios judiciales, defensores de derechos humanos y periodistas, entre otros, alegue que sus derechos humanos serнan violados cuando jamбs йl respetу los de sus vнctimas.
El Estado colombiano reconoce el voto disidente de los dos jueces que se opusieron a esta decisiуn y expresa su preocupaciуn por este tipo de determinaciones que manifiestan un doble rasero sobre los violadores de derechos humanos: mientras se exige a Colombia que no haya impunidad se facilita la impunidad de un criminal confeso de guerra.
El Estado y la sociedad colombiana esperan que las organizaciones de derechos humanos y los organismos multilaterales expresen su rechazo a esta burla a las vнctimas de los crнmenes de los grupos paramilitares en Colombia.

The decision by the European Court of Human Rights to suspend the extradition of war criminal Yair Klein to Colombia is a black mark on human rights in the world. It permits impunity for the crimes committed by Mr. Klein and his paramilitary students in Colombia, denying truth and justice to his victims. This ruling is humiliating for humanity, for the victims, and for the cause of human rights.
The crimes committed by Mr. Kleins students have been proven in Colombia. His role as an instructor is fully documented and his trial was conducted with procedural guarantees. If he wishes to appeal this ruling, Colombian legislation will provide him with the resources to do so.
The argument made by Mr. Klein is false when he states that he could be tortured in Colombia or his human rights could be violated. Klein and the European Court have ignored the fact that a human rights committee is in place in every Colombian prison with inmate representatives, and that, in addition, we have an Office of the Public Defender to watch over the rights of prisoners.
It is a shameful thing that the instructor of the assassins of La Rochela, of Luis Carlos Galбn, of Bernardo Jaramillo Ossa, of Hйctor Abad Gуmez, of hundreds of peasants, of dozens of officials from the justice system, human rights defenders, and journalists, among others, now claims his human rights will be violated when he never respected the rights of his victims.
The Colombian state gives recognition to the dissident voices of the two judges who opposed this ruling. It also expresses its concern for this type of decision that manifests the double standard used for human rights violators: while it is demanded that there be no impunity in Colombia, impunity is facilitated for a confessed war criminal.
The Colombian state and Colombian society call on human rights organizations and multilateral bodies to express their rejection of this mockery of the victims of crimes committed by paramilitary groups in Colombia.
