We the people signing this petition respectfully ask the Honorable Michael E. Cooper, Superior Court Judge, County of Kittitas, Ellensburg, Washington grant Relief of Sentence / Commutation of Sentence to Time Served to Raymond Arlyn Holmes DOC# 904686, now confined at Stafford Creek Correctional Center in Aberdeen, Washington. We understand the facts of this case to include, but are not limited to:

Raymond Holmes was granted an appeal in 1993 for re-sentencing in that his offender score had been miscalculated by another County (Pacific) where he committed crimes and was convicted of prior to being convicted and sentenced for his crimes in Kittitas County in 1988.
The re-sentencing was remanded to Kittitas County Superior Court and heard by Judge Michael E. Cooper on June 14, 1993.
Two re-sentencing options set down by the Washington State Court of Appeals were ignored. In place of correcting his offender score, Raymond's first sentence with a release date of 2010 was thrown out and he was re-sentenced according to Judge Cooper's "own personal feelings" (stated in the trial transcript) to an additional 96 months to run consecutive to the Pacific County sentence, moving his earliest release date upward to 2014. In short, by seeking his right to appeal an error in sentencing and being granted the right to have that error corrected, Raymond received not justice, but additional time to serve. Here, the law of double jeopardy comes into play, as does the unfairness of judicial vindictiveness.
Raymond has served a life sentence, over twenty years to date. He has been incarcerated for crimes committed at the age of twenty-three while he was severely addicted to Metamphetimine and Cocaine. He has not had a positive drug test in all the time of his confinement. He has centered all his efforts into rehabilitating, educating, and reforming himself for his eventual release back into the society he has been paying debt to. At State expense, he has been trained in the vocations of institutional Plumbing and as a qualified HVAC technician I & II with EPA certification. He possesses documentation from a DOC facility requesting a special institutional hold be placed on him due to his much needed skills and the quality of his work ethics. He has received certificates of appreciation & commendation for his involvement & effort in various on-site prison construction projects during his years of confinement.
He is also an accomplished & talented silversmith, another trade he mastered while incarcerated. He is highly employable and ready, willing, and able to accept the role of a taxpayer and become an asset to society. He has a home, family and wife-to-be waiting for him to assume the role of sole supporter. His fiance has serious health issues and has been unable to work and financially support herself for the past year. Her only option is to apply for SSI assistance, creating further burden on the system. In all logic, she needs him to survive; the over-crowded prison system of the State of Washington does not. We implore the court for the early release of this man on the basis of timed served, in the most expedited manner, so that he may assume the role of a productive & responsible member of the community.
