Tënä koe Your Excellency, On behalf of all nga uri o Waitaha I Petition you to use your prerogative under the Letters Patent constituting the office of the Governor-General to appoint a Royal Commission in the name of the Sovereign, Her Majesty Elizabeth ll, a descendant of Her Majesty Victoria the named Sovereign in the Treaty of Waitangi 1840, into the loss of Identity, loss of Mana, loss of histories and loss of Treaty of Waitangi rights and privileges by the Crowns implementation of Acts, Regulations and Policies against nga uri o Waitaha . I seek this Royal Commission in conjunction with Commissions of Inquiry Act 1908: Public Act 1908 No 25 Date of assent 4 August 1908 An Act to consolidate certain enactments of the Parliament of New Zealand relating to commissions of inquiry appointed by the Governor General in Council or by the Governor General Under s 2 of the 1908 Act, the Governor-General may, by Order in Council: “Appoint any person or persons to be a Commission to inquire into and report upon any question arising out of or concerning – (a) The administration of the Government; or (b) The working of any existing law; or (c) The necessity or expediency of any legislation; or (d) The conduct of any officer in the service of the Crown; or (e) Any disaster or accident (whether due to natural causes or otherwise) in which members of the public were killed or injured or were or might have been exposed to risk of death or injury; or (f) Any other matter of public importance.” An inquiry under the Act should therefore be considered when the situation is so unusual that no other approach will do, such as: • There is considerable public anxiety about the matter • A major lapse in Government performance appears to be involved • Circumstances giving rise to the inquiry are unique with few or no precedents • The issue cannot be dealt with through the normal machinery of Government or through the criminal or civil courts • The issue is in an area too new, complex or controversial for mature policy decisions to be taken. It is my contention that Waitaha’s request is applicable under the following; (a) The administration of the Government; (b) The working of existing law; (c) Circumstances giving rise to the inquiry are unique with few or no precedents (d) A major lapse in Government performance appears to be involved (e) The issue cannot be dealt with through the normal machinery of Government or through the criminal or civil courts (f) The issue is in an area too new, complex and controversial for mature policy decisions to be taken. To assist you in our request we attach several Documents in our journey to obtain the objective’s we are seeking. Once the foundation of a Royal Commission has been implemented other documents will be forwarded to assist its passage to correct the bias against Nga Uri O Waitaha We await your earliest reply in these matters.
