Do not pass Hawker Bar's (the 100 group Corp) request for a minor variance to Zoning By-Law Section 12(2)346.(1)(e)(i), By-law 438-86* which states that patios should only be located on the FRONT of a building located on Ossington
Hawker Bar wishes to construct a BACK outdoor patio between the rear wall of Hawker Bar and their rear lot line. The patio is directly adjacent (no less than 5 feet) to properties that have residential uses, including families with children. This BACK patio will be facing a residental street with noise affecting all.
If Hawker Bar is allowed to open licensed patio with a smoking area at the BACK of their structure, all of its immediate neighbors will be subject to constant noise, cigarette smoke and more garbage. These neighbors and their children will be put at risk if customers are innebriated and out of control.
Hawker bar has not provided any convincing solutions in its proposed "Garden Patio Conditions" to their immediate neighbors that prove they can control the issues that are of concern: noise, smoke, garbage, safety.
Past experience of many residents in Toronto adjacent to Bars and Clubs in Toronto demonstrates that owners of such bars and clubs cannot be trusted to police such matters and rarely do. Police and bylaw officers are reluctant to enforce "conditions" agreed to by these bar/club owners and therefore promised conditions are rarely relevant.
This variance is not a minor variance. It is not desirable for the appropriate development or use of this land because there are residences adjacent. It does not maintain the general intent and purpose of Zoning By-Law Section 12(2)346.(1)(e)(i), By-law 438-86
*no person shall use land for the purpose of a patio unless the patio is located between the front wall of the building or structure housing the principle use and the front line of the lot, provided the front lot line of such lot is on Ossington Avenue.
