Respected Madam,
I am practicing lawyer since last 28 years at exclusively criminal side. I want to suggest some important amendments in Juvenile Justice Act. The incident which happened at Mumbai dated 26/11/2008 is very bad and in that one terrorist is arrested. He tried to take the benefit of Juvenile Justice Act by submitting that he is a juvenile offender i.e. he is below 18 years. Now what may happen that the other countries will give training to the young boys who are below 18 years and they will be saved from sever punishments & hence I wish to suggest that there must be an amendment that the Juvenile Justice Act will not be applicable to the juveniles of the other countries as well as the juveniles who indulges into anti national activities as well as indulges into terrorist activities have to be excluded from Juvenile Justice Act and be tried under the provisions of Criminal Procedure Code and they are also liable to the sentence as per Indian Penal Code. If this amendment is not there then our judicial system also can not punish them severely. So to avoid further events and incapability in the law the amendments mentioned below should be there.
In Juvenile Justice Act, 2000 in Chapter No I PRILIMINARY.Short title extent and commencement -
(1)This Act may be called THE JUVENILE JUSTICE (CARE AND PROTECTION OF CHILDREN) ACT 2000.
(2)It extends to the whole of India except the State of Jammu & Kashmir.
(3)This Act is not applicable to who are not citizens of India and who are citizen of India but waging war against nation (India)
(4)It shall come into force on such date as the central Government may, by notification in the Official Gazette, appoint
So according to me if the above bold typed portion i.e. Section (3) will be added & amended then the activities of Juvenile in future will be restricted.
