Dear Honorable Chief Judge Peter B. Krauser and all Honorable Judges of Maryland Court of Special Appeals:

We are writing to you regarding the case of Ms. Qihui Huang v. Centex Homes, et al, which is set for your judgment around January of 2009.

Ms. Qihui Huang is a foreign born Asian American woman and the sole home purchaser. Ms. Huang purchased a townhouse (with price of $326,585) developed by Centex Homes in 2004. The property had unfinished grading, vegetation, sod, landscaping, and driveway, when Centex and its subsidiaries (lender and title companies) forcibly sold the property to Ms. Huang, even though those conditions disqualified the property for the issuance of a use and occupancy certificate. Also, Centex Homes and its subsidiaries forced Ms. Huang to accept their bad loan term when they knew Ms. Huang qualified for better loan terms. After Ms. Huang forcibly became the owner of the property, Centex Homes intentionally, maliciously, and repeatedly injured Ms. HuangЇs property as they freely used her property to benefit their commercial actions. After more than four years of being forced to purchase her property, it still remains incomplete. Ms. Huang was the only home purchaser that suffered such miserable treatments from Centex Homes, who built about 52 houses in the same community.

On November 21, 2006, Ms. Huang filed her lawsuit at the Maryland Circuit Court for Montgomery County, alleging that Centex Homes, its subsidiaries, and some managers violated Maryland Consumer Protection Act, Breach of Contract, housing discrimination laws, etc. The trial judge dismissed her complaint with prejudice without hearing any merit of the case, because she did not hear (due to her hearing impairment) trial judgeЇs oral order to timely amend her complaint when Centex Homes argued that Ms. HuangЇs complaints and amendments were indecipherable (since they had no other facts nor laws to argue.)

Now, this Court ruled that this case shall be decided without oral argument when Ms. Huang requested it, which shows that the Court agreed with several doctorsЇ notes that Ms. HuangЇs hearing was impaired. Wherefore, Ms. Huang should not be punished by the trail courtЇs order of dismissal with prejudice, caused by her poor hearing of disabilities.

Ms. Huang received two Master of Science degrees in the University of Maryland, College Park, and Johns Hopkins University separately. Ms. Huang was co-authors with two Nobel Prize Laureates in three publications on Nobel Prize winning project. Ms. Huang is a top grade level federal government employee. Ms. Huang, pro se, filed several other lawsuits in other courts, wrote and submitted many documents in the courts. Among that, Centex Homes was the only one stated indecipherable and only on her complaint and amendments, but not on her other documents submitted in courts. We, undersigned, could decipher and understand documents, complaint, and/or amendments written by Ms. Huang.

Centex Homes did not dispute Ms. Huang stated facts and with merits, the trial judge did not hear its merits, but dismissed with prejudice, which contradicted with the Maryland statutes as stated when a case has not in fact been heard on the merits, dismissal should ordinarily be without prejudice, see Bodnar v. Brinsfield, 483 A.2d 1290, 1297-1298 (Md,App.1984).
We are concerned about this case and strongly support Ms. Huang in her lawsuits against Centex Homes and its subsidiaries. We respectfully request the Honorable Judges to rule in favor of Ms. Huang or to provide statutes and explanations when denying Ms. HuangЇs appeal.
